Purpose– The purpose of this paper is to review the digital piracy literature and present the positive impacts of digital piracy and its benefit to businesses. A great deal of the literature discusses the consequences of digital piracy, but, in most cases, the focus is on the negative consequences.Design/methodology/approach– The authors draw on both the theoretical and empirical academic literature on digital piracy so as to analyze the ways in which digital piracy positively contributes to digital businesses.Findings– The paper provides (...) information on the positive consequences of digital piracy and demonstrates that the benefits include product diffusion, network externality, innovation, cost reduction, an effective promotional and publicity vehicle, and technology standardization.Originality/value– This paper investigates potential benefits of digital piracy and provides insights which may offer a fuller picture of the consequences of digital piracy. Adopting an Ethics of Care theoretical framework, this paper aims to investigate the way in which the owner-mangers (OMs) of small and medium-sized enterprises in Malaysia engage in human resource management. Based on in-depth interviews with 48 OMs, the findings show that HRM practices occur within the remit of management but are described by the managers in terms of relational obligations and cannot be fully accounted for using a strategic, instrumental, or critical lens. The present study highlights the importance of (...) the caring attitudes of OMs who adopt a humanistic management approach, responding to the varied needs of their employees and the obligations which are inherent to relationships between humans. The Ethics of Care (EoC) theory has been widely applied in the field of management, and there is a growing consensus that it is important to recognise the value and practice of care in the workplace. In this paper, we consider the implications of the EoC at work, and in particular the risks unboundaried care demands may pose to employees who encounter unmanageable ‘calls to care’. We present findings from interviews with 27 nurses in Malaysia, which suggest that the demand (...) to care at work, in addition to demands made in the non-work sphere, may be unmanageable. The cost of basic income is typically estimated for a particular year. However, to assess the financial feasibility of basic income, it is also important to consider how much basic income will cost in the future. This is especially important in countries experiencing an ageing population, where the proportion of workers is expected to shrink. This article considers basic income as a universal life annuity and develops two models based on actuarial concepts to estimate the flat tax rate required to (...) finance basic income. The first model considers the cost of basic income over the lifetime of the current population and the second model additionally considers changing population dynamics. The proposed models are conceptually simple, providing a straightforward way to assess the financial feasibility of basic income. Using Singapore data, the models show that the monthly cut-off income separating net contributors and net recipients is around $2710 and benefits around 39 % of adult residents. A tax rate of around 22 % is required to support a basic income of $600. (shrink)

Animal ethicists have recently debated the ethical questions raised by disenhancing animals to improve their welfare. Here, we focus on the particular case of breeding hens for commercial egg-laying systems to become blind, in order to benefit their welfare. Many people find breeding blind hens intuitively repellent, yet ‘welfare-only’ positions appear to be committed to endorsing this possibility if it produces welfare gains. We call this the ‘Blind Hens’ Challenge’. In this paper, we argue that there are both empirical and (...) theoretical reasons why even those adopting ‘welfare-only’ views should be concerned about breeding blind hens. But we also argue that alternative views, which (for example) claim that it is important to respect the telos or rights of an animal, do not offer a more convincing solution to questions raised by the possibility of disenhancing animals for their own benefit. René Descartes is often thought to have exerted a pernicious influence on our views concerning the relationship of humans to the environment. The view that because animals are machines, “thoughtless brutes,” they have no moral standing, and we thus have a right to use them to further our own interests, is attributed to him. A celebrated passage from the Discourse on Method adds fuel to the view that he subscribes to the “dominion” theory. I argue that this picture is misleading (...) and unfair. Descartes does not hold the dominion theory, and there is evidence that he accords animals (and plants) moral standing. Most importantly, Descartes holds that it is a human good to subordinate one’s interests to those of the larger universe. He can, in fact, be seen as a forerunner of modern ecocentrism. (shrink)

This study evidences turn actions done by ellipsis marks-only turns and blank turns as employed in quasisynchronous chats that are not discussed in prior literature. A brief introduction to the research background of ellipsis marks in online chats is followed by a description of the data collected before delving into the actions done by ellipsis marks-only turns and blank turns. Data were culled from multi-party chats among tertiary students during a critical reasoning class. A Conversation Analysis-informed approach is applied in (...) this article to analyze the preference organization of elliptical turns that illustrate several turn actions which include responses signaling disagreement, confusion and disapproval besides initial actions of eliciting responses and holding the floor. More than punctuation marks or paralinguistic restitution of silences, their interpersonal meaningfulness in sequential context and differentness/similarity vis-a-vis temporal silences are demonstratively shown in microscopic and interpretive description of chat excerpts. In Singapore’s multicultural society, a sizable proportion of the population subscribes to complementary and alternative medicine. In this article, we discuss the impact this has on medical practice in the context of the four principles of medical ethics. To uphold the principle of autonomy, we propose a non-judgmental approach towards patients who use CAM. Nevertheless, in order to promote health and prevent harm, the safety profiles of CAM must be studied through systematic research. In addition, the principle of justice is (...) one concerned with the fair distribution of scarce healthcare resources, while granting equal access to healthcare regardless of beliefs. Understanding CAM from an ethical perspective allows for the provision of safe, holistic, and culturally relevant care. (shrink)

Social enterprises combine activities, processes, structures, and meanings associated with multiple institutional logics that may pose conflicting goals, norms, values, and practices. This in-depth multi-source case study of an ecological social enterprise in Malaysia reveals how the enactment of the family logic interacts with the market and ecological logics not only in conflicting but also in synergetic ways. By drawing attention to the institutional logic of the family in social entrepreneurship, this study highlights the heterogeneity of social enterprises. The findings (...) have implications for research with social enterprises and family-owned firms in relation to the ethical obligations of these organizations and the interactions of multiple logics. In addition to a code of conduct for researchers, it is desirable to implement a code of conduct for funders of research. This is because researchers often behave unethically as a result of direct and/or indirect pressure from funders. The paper provides an expansion of the first proposal for such a code of conduct and includes several elements such as “policy relevant research should not be contracted and supervised by a client with an interest in the outcomes”, and “policy relevant (...) research should always be examined by an independent institute”. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. Last, Part V discusses the relevance of empathy to our understanding of justice and legal morality. (shrink)

The differentiation of trait anxiety and depression in nonclinical and clinical populations is addressed. Following the tripartite model, it is assumed that anxiety and depression share a large portion of negative affectivity, but differ with respect to bodily hyperarousal and anhedonia. In contrast to the tripartite model, NA is subdivided into worry and dysthymia, which leads to a four-variable model of anxiety and depression encompassing emotionality, worry, dysthymia, and anhedonia. Item-level confirmatory factor analyses and latent class cluster analysis based on (...) a large nation-wide representative German sample substantiate the construct validity of the model. Further evidence concerning convergent and discriminant validity with respect to related constructs is obtained in two smaller nonclinical and clinical samples. This article continues the themes developed in a previous paper looking at reparations for past wrongs in post-colonial Australia. It narrows the focus to examine the scope of the law of tort to provide reparations suffered as a result of colonisation and dispossession, with particular emphasis on the assimilation policies whose legacy is now known emphatically, although it ought not be exclusively, as the Stolen Generations. The search for more than just words is particularly topical in light of the Australian (...) Prime Minister’s formal apology in early 2008. This highly symbolic step must not lose momentum. That momentum could be both political and legal. In the latter context, we explore here the concept of alien tort, in the light of current Australian tort jurisprudence, which has thus far proved inadequate to achieve compensation for the harms suffered. Taking a comparative approach, procedural and substantive developments are to better deliver justice consistent with community values. In particular, the greater acceptance of psychological harm as actionable tortious conduct in Canada and the United States is examined. The article further examines the scope for stolen children to bring suit under the US Alien Tort Claims Act 1789. While the Australian government enjoys sovereign immunity in the courts of the United States, non-state organisations such as churches that were complicit in the forcible removals may be subject to United States jurisdiction wherever they have a presence in that country. The procedural and substantive elements of such a claim are discussed. In particular, the relevant cause of action, the issue of forum non conveniens and the statute of limitations will be analysed to map out whether a claim could be developed and successfully prosecuted. The nature of the census figures produced by Demetrius of Phaleron, crucial evidence for the size of the Athenian population, has been misunderstood. The census categories were not 'native Athenians, foreign residents and slaves', but 'citizens above the property qualification, residents without political rights and members of households'. The property qualification of 1,000 drachmas associated with Demetrius' regime was the requirement for holding the highest offices; the property requirement for citizenship rights was lower, as it was in the spurious constitution (...) of Draco described in Athenaion Politeia 4, which was probably invented and inserted during Demetrius' reign. In the light of this reinterpretation of the evidence for the structure of the Athenian population under Demetrius, a reconsideration of the evidence for the size of the Athenian population in 322 BC suggests that there were ea. 30,000 adult male citizens and far fewer metics than generally assumed, probably ea. 5,000. The distribution of property among the citizen population was very uneven, with the richest 30% of the population owning about 80% of the wealth. According to Demetrius' census as reinterpreted here, slaves outnumbered free residents by 'only' about 3:1, which still seems an implausibly high figure, but needs to be taken seriously as a government estimate rather than a rhetorical exaggeration.
